You must provide accurate information when creating an account.
You are responsible for keeping your account credentials secure and for activity carried out through your account.
You must not:

4. Software License
Subject to these Terms and your payment of any applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, and revocable license to install and use the Brodo software for your personal or internal business use.
You do not acquire ownership of Brodo or its underlying software, source code, trademarks, or other intellectual property.
You may not sell, sublicense, distribute, rent, lease, or otherwise commercially redistribute the Brodo software unless we have expressly authorized you to do so.
Nothing in these Terms limits rights that cannot legally be excluded under applicable law.
5. Your Content and Data
You retain ownership of the writing, projects, notes, and other content you create or store while using Brodo.
Brodo does not claim ownership of your writing.
The Brodo desktop application is designed to store writing-related information locally on your computer. Your manuscript or document text is not intentionally uploaded to Brodo's servers during normal operation.
You are responsible for maintaining appropriate backups of your own content.
Brodo is not responsible for loss of locally stored content resulting from device failure, operating-system failure, user action, or circumstances outside our reasonable control.
Our processing of personal data is described in our Privacy Policy.
6. Payments
Paid Brodo features are available according to the plans and prices displayed at the time of purchase.
Payments are processed by Stripe.
By making a purchase, you authorize Stripe to process the applicable payment.
Where applicable, subscriptions may automatically renew according to the terms shown during checkout.
You can manage applicable subscriptions through the Stripe billing portal or other account controls provided by Brodo.
Taxes and charges required by applicable law may be included in the displayed price or added at checkout where applicable.
7. Trials and Promotional Offers
If Brodo offers a free trial or other promotional offer, the applicable conditions will be presented when you sign up.
We may change, suspend, or discontinue promotional offers at any time, subject to rights that have already accrued.
Unless otherwise stated during signup, a free trial does not create an obligation to purchase a paid plan.
8. Consumer Right of Withdrawal
If you are a consumer in the European Union or another jurisdiction providing a statutory right of withdrawal for online purchases, you may have a right to withdraw from your purchase within the applicable statutory period, normally 14 days for distance contracts.
For digital content supplied electronically, the statutory right of withdrawal can cease once performance begins where:
- you have expressly consented to the immediate performance before the withdrawal period expires;
- you have acknowledged that you will lose your right of withdrawal as a result; and
- the other applicable legal requirements for this exception have been satisfied.
Where required, Brodo will obtain the appropriate consent and acknowledgment before providing paid digital content immediately.
If the statutory right of withdrawal still applies, you may exercise it by contacting us through:
You may also use any applicable statutory withdrawal form.
Where a valid withdrawal is exercised, refunds will be made in accordance with applicable law. Under Italian consumer law, refunds are generally made without undue delay and no later than 14 days after the trader is informed of the consumer's withdrawal, subject to applicable statutory rules.
Nothing in these Terms limits any mandatory consumer rights you have under applicable law.
9. Legal Guarantee and Digital Content Rights
If you are a consumer, Brodo is subject to the mandatory statutory rights and remedies applicable to digital content and digital services in the jurisdiction where you are protected as a consumer.
Where Brodo does not conform to the applicable legal requirements, you may have statutory rights including, where applicable, bringing the service into conformity, receiving an appropriate price reduction, or terminating the contract and receiving a refund.
These statutory rights apply regardless of anything else in these Terms.
10. Updates and Changes to Brodo
We may release updates, improvements, bug fixes, or security updates for Brodo.
Some updates may be necessary for security, compatibility, or continued operation of the service.
We may modify or discontinue particular features where reasonably necessary to operate or improve Brodo.
Where applicable law requires notice or provides you with specific rights as a result of a material change, those rights will apply.
11. Availability
We aim to keep Brodo available and functioning reliably, but we do not guarantee that the website, backend services, downloads, or application will always be available, uninterrupted, or error-free.
Brodo may occasionally be unavailable because of maintenance, updates, technical problems, third-party service outages, security incidents, or circumstances outside our reasonable control.
This does not affect mandatory consumer rights relating to conformity or availability under applicable law.
12. Third-Party Services
Brodo relies on third-party services, including Stripe, Supabase, Vercel, Railway, Cloudflare, PostHog, Sentry, and Resend.
Third-party services may be subject to their own terms and policies.
We are not responsible for failures or changes to third-party services outside our reasonable control.
13. Intellectual Property
Brodo and its software, website, design, branding, logos, graphics, text, and other materials provided by Brodo are owned by or licensed to Marcus Rothoff and are protected by applicable intellectual-property laws.
Except for the limited license granted by these Terms, no rights are transferred to you.
You retain ownership of content you create yourself using Brodo.
14. Prohibited Use
You may not use Brodo to:

- Circumvent licensing, payment, or access controls
- Distribute malware or other harmful code

We may suspend or terminate access where reasonably necessary to prevent abuse, protect Brodo or its users, or comply with legal obligations.
Where appropriate and legally required, we will provide notice before termination.
15. Suspension and Termination
You may stop using Brodo and delete your account at any time.
We may suspend or terminate an account if:
- You materially breach these Terms;
- Your use creates a security or legal risk;
- You engage in fraud or abuse; or
- We are required to do so by law.
Termination does not affect rights or obligations that arose before termination.
Any mandatory consumer rights remain unaffected.
16. Limitation of Liability
To the maximum extent permitted by applicable law, Brodo is not liable for indirect, incidental, special, consequential, or unforeseeable losses arising from your use of the service.
We are not responsible for loss of content that is stored only on your device where the loss results from circumstances outside our reasonable control or from your failure to maintain backups.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for fraud, intentional misconduct, or rights and remedies that cannot legally be excluded.
For consumers, mandatory statutory rights and remedies are not limited by this section.
17. Force Majeure
We are not responsible for failure or delay in performing our obligations where caused by circumstances beyond our reasonable control, including major internet or infrastructure failures, natural disasters, war, governmental actions, widespread cyber incidents, or failures of third-party providers.
This does not affect mandatory consumer rights.
18. Changes to These Terms
We may update these Terms when Brodo, our services, or applicable legal requirements change.
The updated version will be published on this website with a new "Last updated" date.
Where required by law, we will provide additional notice of material changes.
If you continue to use Brodo after the updated Terms take effect, the updated Terms will apply to your future use of the service.
19. Governing Law
These Terms are governed by the laws of Italy, except where mandatory consumer-protection laws in your country of residence provide otherwise.
If you are a consumer residing in another country, nothing in this section deprives you of mandatory rights or protections that apply to you under the law of that country.
20. Disputes and Consumer Rights
We encourage you to contact us first so that we can attempt to resolve any dispute informally:
Nothing in these Terms prevents a consumer from exercising any mandatory right to bring a claim before the courts or authorities available under applicable consumer-protection law.
